Until you get a refund from either eBay or Paypal, that kit is still yours. The fact that he's listing it for sale, has your money and hasn't shipped, constitutes theft...possibly fraud. You may want to contact either the Seattle police or the FBI since it was a sale of over $1000 across state lines. You also may want to send eBay the link, since they didn't seem to be too helpful when you contacted them.

No he has my money, the drums and is selling them again.
I am curious to see how many times he sells the same set before ending up in a ditch somewhere .
Geez dude, I am very sorry to hear that. The situation seems pretty clear cut though, as in, surely you must have recourse? I can't imagine that you will just lose your money.

The dirt bag responded to an email my wife sent asking if the kit was still available.
Hopefully, you used your Credit Card through Paypal, and not your Bankcard/a.k.a. fake Visa.???
If you did, I would contact them right away and start a dispute case. Even if he's withdrawn the cash(which he probably has) and deposited into his account, they can reverse it.
You will need to tell them the whole story. Make sure FRAUD is used in you verbage.

I was almost screwed out of $3400 back in 1999 on a Pearl Master Series kit that I "consigned" for a "dealer" to sell for me. After 90 days, he'd pay me rather he sold them or not. Well, 90 days came, I waited for the check. Instead I got a bankruptcy notice. Long story short, I drove 6 hours and came home with a similar kit, cymbals, and a $400 check the dirtbag thought he post dated. Ended up loosing only about $200 out of the deal.Hmmmm
Well the guy is still selling the set local, admits it is the kit that was on ebay, says I backed out......yet still has my money, the kit and is trying to sell again.
Is this moron still playing dumb (aka lying) about the bass drum's origination to potential other buyers? Still think someone in the Seattle area should visit him in person and give him hell.
If this guy is as big a crook as he appears to be the only people that will get his attention are the Seattle Police. If they haven't been called yet, then they should be, it's pretty well an open and shut case. Manny, I'm sure you have proof of purchase...either from the credit card or paypal. That, and a copy of his listing is really all you need.
